Airbnb, Hotel and Resort Injury FAQ

What if I am injured at an Airbnb or vacation rental?

Seek medical care and preserve the booking, property listing, host messages, photographs and any report. Potential responsible parties can include the property owner, manager, contractor or others. A platform’s liability should not be assumed merely because it handled the reservation.

What if I slip in a hotel lobby or on hotel stairs?

Report the fall, photograph the exact condition and warnings, identify witnesses and request preservation of surveillance footage and inspection records. A negligence claim turns on the facts.

What if there was carbon monoxide exposure?

If exposure may be occurring, leave immediately, contact emergency services from a safe location and obtain medical attention. Preserve emergency responder reports, medical records, equipment information and rental records when safe.

Does a rental agreement or waiver prevent a claim?

Not automatically. Agreements may include arbitration, forum, waiver or insurance terms whose effect depends on the language and applicable law. Save the complete agreement.

What if the injury happened outside Massachusetts?

Jurisdiction, choice of law, limitation periods and evidence-gathering can be different. Seek timely advice before assuming Massachusetts law applies.
