International Travel Injury Lawyers

Injuries during international travel can involve unfamiliar law, overseas evidence and multiple businesses in different countries. Muggeo & Associates evaluates potential claims involving hotels and resorts, vacation rentals, tours, transportation, excursions and other travel-related incidents. The location of the injury does not, by itself, establish which court may hear a claim or which party may be legally responsible.

International Injury Cases We Evaluate

  • Hotel, resort and vacation rental slips, falls and unsafe property conditions
  • Injuries on organized excursions, theme parks and recreational activities
  • Tour bus, taxi, transfer and other transportation accidents
  • Aircraft and airline passenger injuries during international trips
  • Cruise and shore-excursion injuries
  • Carbon monoxide exposure or other serious incidents at lodging

Jurisdiction, Applicable Law and Deadlines

Cross-border disputes may require review of foreign law, personal jurisdiction, choice of law, contract provisions, forum-selection clauses and potential arbitration terms. Different deadlines may apply, including special requirements for international air travel or cruise tickets. We investigate those issues early and assess whether coordination with counsel in another jurisdiction is appropriate.

Preserving Evidence Abroad

Keep the entire itinerary and booking confirmation, receipts, contracts, photographs, video, witness contact information, foreign incident reports and medical records. Ask about preserving surveillance footage or maintenance records as soon as practicable. Preserve translations and original-language documents.

FAQs

Can I sue a U.S. travel company for an accident overseas?

Possibly, but the company’s role, contractual arrangements, court jurisdiction and governing law must be evaluated. Booking through a U.S. business does not automatically establish liability or a U.S. forum.

What if the injury occurred on an international flight?

Covered international aviation claims may involve the Montreal Convention, including special rules on liability and filing deadlines. Preserve your ticket and full itinerary and seek counsel promptly.

Can a foreign hotel or resort be responsible?

Possibly. The hotel’s legal duties, control of the location, cause of injury and forum questions depend on the circumstances and relevant law.

Do hotel booking terms decide where an overseas injury case must be filed?

Contractual terms can matter, but jurisdiction, enforceability and potentially applicable foreign laws require case-specific review.

What if I was hurt on an international excursion booked through a cruise or resort?

Preserve receipts and all booking terms, including the excursion operator’s identity. Several entities and different contracts may be involved, but their legal responsibility must be established.

Can I seek assistance from U.S. counsel while overseas?

You can contact counsel, although the feasibility of a U.S. claim and need for counsel elsewhere depend on the incident, the parties and governing law.
