Florida Law Changed in 2023

In March 2023, Florida enacted major tort reform legislation (commonly known as HB 837) that significantly affects injury claims. If you were hurt in Florida, these changes may apply to your case:

  • Shorter deadline. For most negligence claims arising after the law took effect, the time to file a lawsuit was reduced from four years to two years.
  • Modified comparative negligence. Florida moved from a pure comparative fault system to a modified system. In most negligence cases, an injured person found more than 50% at fault cannot recover damages. Medical negligence claims are treated differently.
  • Medical damages evidence. New rules limit the evidence that can be used to prove past and future medical expenses, including amounts actually paid and treatment under letters of protection.

Because these rules are new and still being interpreted by Florida courts, the timing of your accident and your claim can make a real difference. Do not wait.

Florida No-Fault Insurance

Florida is also a no-fault state for auto accidents. Personal Injury Protection (PIP) coverage pays a portion of medical bills and lost wages regardless of fault, subject to policy limits and treatment-timing requirements. To recover pain and suffering damages from an at-fault driver, an injured person generally must show a qualifying permanent or significant injury. Seeking medical care promptly after a crash is especially important in Florida.
